1. About these terms
These terms apply to all driving tuition booked with mint2pink. Please read them before booking. By booking tuition you accept them.
mint2pink is the trading name of Tom Morris, a sole trader. In these terms “I”, “me” and “mint2pink” mean the same thing, and “you” means the person booking tuition.

Where tuition is paid for by someone other than the pupil — a parent or grandparent, for example —
the tuition contract is with the pupil. All matters relating to payment and refunds are dealt with between me and the person who made the payment.
2. Your tuition
Your contract is with me directly. I am a DVSA Approved Driving Instructor and I teach every lesson
personally. If anything goes wrong at any stage, it is mine to put right.
3. Prices and payment
My current prices are those published at mint2pink.co.uk/prices at the time you book. The price
confirmed to you at booking is the price you pay.
Lessons are booked in blocks. Intensive and semi-intensive courses are booked by total course hours. I do not offer an hourly rate.
Payment is made by bank transfer once your lesson or course has been confirmed as available.
I am unable to accept cash or cheques.
4. Booking an intensive or semi-intensive course
Where possible, your course will be preceded by a Trial90 assessment lesson so that I can tell you
honestly how many hours you need. Where a course is booked at short notice, it may not be possible to
assess you before your dates are confirmed. In that case you book on the basis of the information you
have given me, and all of these terms apply in full.
The Trial90 is booked and paid for separately at my published Trial90 rate. It is not part of your course
and its fee is not included in the course price. Where there is not time to carry out a Trial90 before an
agreed course begins, no Trial90 fee is charged and the course proceeds without it.
Deposit. A deposit of 25% of the course price is payable at the point your booking is accepted. Your
course dates are not held until the deposit is received. The deposit is non-refundable, except under
section 5, where it is either refunded in full or counted towards the tuition already delivered.
Balance. The outstanding balance is payable no later than 6 weeks before your course start date.
Courses starting within 6 weeks. Where I am able to offer a start date less than 6 weeks away, the full
course price is payable at the point your booking is accepted.
If the balance is not paid. Where the balance is not received by the due date, I may release your dates
to another pupil. Your booking is then treated as cancelled by you, your deposit is retained, and section 6 applies to any balance paid. I will always contact you before releasing dates.
5. Cancelling within 14 days
If your booking is made by telephone, email or online, you may cancel without giving a reason within 14
days, starting the day after we agree the booking. This does not limit any longer cancellation right the
law may give you.
In this section, your tuiton begins with the first hour of the course or block you have booked. A Trial90
taken beforehand is a separate booking and does not begin your course.
If you cancel before tuition begins. I will refund everything you have paid, including your deposit.
If you want tuition to begin during those 14 days. I will ask you to request this expressly before tuition
starts, and to acknowledge that if all the tuition covered by your booking is delivered within those 14
days, your cancellation right will end on completion. You will be asked to confirm:
I am asking mint2pink to begin my tuition within 14 days of booking. I understand that if
all the tuition covered by this booking is delivered within that period, my right to cancel
will end when it is completed.
If you cancel after tuition has begun but before it is completed. You will pay a proportionate amount for
the tuition already delivered, based on the agreed price and hours for your booking. Your deposit counts
towards that amount. I will refund anything remaining.
Once all the tuition covered by your booking has been delivered. Your right to cancel under this section
ends, provided you made the express request and acknowledgement above.
Where this section conflicts with section 6 or section 7, this section applies.
To cancel, tell me clearly by calling 07715 056 100 or emailing info@mint2pink.co.uk. Any refund due
under this section is made without undue delay and within 14 days of my being told you wish to cancel.
Your statutory rights are unaffected.
6. Changing or cancelling lessons and courses
Outside the 14-day right above, the following notice applies:
• Individual lessons (90-minute, two-hourly and Trial90): 48 hours before the lesson start time.
• Intensive and semi-intensive courses: 6 weeks before the course start date.
Give that notice and the balance you have paid is refunded under section 7. Your deposit is retained,
except where section 5 applies.Where I offer you a course start date less than 6 weeks away, the 6 weeks’ notice above cannot be given.
Once your rights under section 5 have ended, that booking cannot be cancelled for a refund. I will tell
you this before you accept those dates.
Lessons or courses cancelled with less than the required notice are chargeable in full, as the time cannot be re-filled at short notice.
If I need to cancel or move a lesson or course, I will give you as much notice as I can and you will never be charged.
7. Refunds
Apart from your cancellation rights under section 5, refunds are available in two situations only.
7.1 You pass your test with hours remaining
Where you pass your DVSA practical test with me and have hours remaining from your block or course,
those hours are refunded at the per-hour value of the booking you paid for.
For example: you book 9 hours at £369 — a per-hour value of £41 — and pass with 1 hour unused. That hour is refunded to you at £41.
This applies only where your training is completed with me and your pass is achieved on a test taken as
part of that training.
7.2 You cancel before training begins, with the required notice
Where you cancel before your training begins and give the notice required by section 6, any balance you
have paid is refunded. Your deposit is retained.
7.3 In all other cases
No refund is due. In particular, no refund is due where you stop part-way through a block or course,
whatever the reason, or where you do not use your hours within the 12-month period in section 8. This
does not affect section 5 or your statutory rights.
7.4 How refunds are made
Refunds are made only to the person who made the original payment. Where tuition has been paid for
by someone else — a parent or grandparent, for example — any refund is returned to them and must be requested by them.
Refunds are returned by the same payment method used to book. Where that is no longer possible, I will
agree an alternative method with the original payer. Refunds normally reach the account within 10
working days. I may ask for confirmation of identity first.
All refunds are subject to the 12-month validity period in section 8. Tuition bought with a gift card or
voucher cannot be refunded in cash once redeemed. Tuition is personal to you and cannot be sold or
transferred to anyone else.
8. How long pre-paid tuition lasts
Pre-paid tuition is valid for 12 months from the date of payment. Within that period your hours are
honoured at the price you paid, regardless of any price increase.
Block and course rates are discounted against smaller bookings. That discount is offered in exchange for
your commitment to complete the tuition within 12 months.
Hours not taken within 12 months of the date of payment expire. After that date they cannot be used,
extended, transferred or refunded, and no extension is available in any circumstances.
It is your responsibility to use your hours within the 12-month period.
9. Vouchers, gift cards, offers and discounts
Vouchers and gift cards hold no cash value and are redeemable against tuition only. Once redeemed they
are not transferable.
I run offers from time to time and may introduce or withdraw them at any point. Introductory offers are
for new pupils only, cannot be combined with other offers, and are not transferable.
10. Driving tests
The DVSA requires ten clear working days’ notice to move or cancel a practical test. If you give less notice
you may lose your test fee, and I am not liable for a lost DVSA test fee.
I will tell you honestly whether you are ready for test. If in my professional judgement you are not ready,
I am not obliged to present you for test, and I will explain clearly what is still needed. This is a safety
judgement and is not a basis for a refund of tuition already delivered.
Use of my tuition vehicle for your practical test is by prior arrangement and is confirmed in writing when
your course is booked.
11. Insurance
I carry appropriate motor insurance covering you as a learner driver while in control of my tuition
vehicle.
12. My responsibility to you
If I fail to meet these terms, I am responsible for loss or damage you suffer that is a foreseeable result of
that failure. I am not responsible for loss or damage that is not foreseeable, that results from something
outside my reasonable control, or that arises from your own breach of these terms.
I am not liable for business losses, including lost profits, lost earnings, lost opportunity or business
interruption.
I do not exclude or limit my liability for death or personal injury caused by my negligence, for fraud, or
for anything else that cannot lawfully be excluded. Nothing in these terms affects your statutory rights as
a consumer.
13. Complaints
If something is wrong, tell me early and I will put it right. Raise it with me directly on 07715 056 100 or at info@mint2pink.co.uk and I will respond within 5 working days. If you would prefer to put it in writing, you can write to me at 28 Alexandra Terrace, Exmouth, EX8 1BD.
If you remain dissatisfied, you may contact the Driver and Vehicle Standards Agency on 0300 200 1122.
14. Governing law
These terms are governed by the law of England and Wales and are subject to the non-exclusive jurisdiction of the English courts.
